Caloocan road rage: 58-year old man shot dead


A motorcycle's bright LED headlight caused these men a deadly dispute in Caloocan.

A 58-year old man died after getting into a fight over a motorcycle's bright LED headlight. The man was shot dead by the motorcycle's driver. The incident took place in a subdivion in Caloocan City past midnight, Monday.

Nelson Belen who lives in the subdivision in Barangay 173, Caloocan City, was shot repeatedly by Ardy Cristobal, 43, an electrical engineer. Belen suffered from three gunshot wounds in the chest.

Belen, on board a Ford Ranger pickup, was then coming from a restaurant he owned, the Kubo Grill, traveling along the Senate Avenue inside the Senate Village in Barangay 173, when he got irritated by the glaring headlight of Cristobal's motorcycle said Senior Supt. Bartolome Bustamante, Caloocan City police chief.

During the incident, Cristobal was with Joseph Ochona, said Reydante Ariza, chief of Caloocan City Police North Extension office.

According to Bustamante, a heated altercation happened between Belen and Cristobal. Belen reversed his car and withdrew to his home in Barangay 173 while Cristobal went home at Carissa Homes subdivision in Barangay 171, after several minutes.

The two went back to the same spot where they had an argument for some reason.

Belen went out of his car and fired at Cristobal's feet upon seeing him on board a Honda CRV. Belen used his 45-firearm to give Cristobal a lesson, said Bustamante. Cristobal was injured, police said.

However, Cristobal who is a professional shooter, made his counterattack. He took out his licensed Thunder 45 ultra Compact Pro firearm and shot Belen three times in the chest. Belen was killed on the spot, Ariza said.

Cristobal left Belen's body at the crime scene immediately. He went to the Police Community Precint Station 6. He surrendered and turned over his loaded firearm and magazine to the police. Then, he left for the Philippine Orthophedic Center where he got treatment for his injury, police said.
On Monday afternoon, Cristobal also underwent a judicial inquiry and could be charged either with murder or homicide. He would definitely be made to answer his violation for the existing election gun ban, police said. Ariza said that Cristobal would file a frustrated murder counter-charge against Belen and he would cite self-defense in responding to the criminal case against him. Also, he would be detained at the Caloocan City Police North Extension office after the inquest proceedings.

There were 45-gun and four fired cartridge cases beside Belen recovered from the crime scene. And, 16 fired cartridge cases from a 45 gun; a deformed slug; and four metallic fragments from a jacketed fired bullet.

Belen probably just wanted to scare Cristobal. He underestimated the suspect who's trained in handling guns, Bustamante said. Police are still checking if Belen or Cristobal was drunk during the shooting.

Cristobal and Belen both had licensed firearms, but were not exempted from the electrion gun ban, Bustamante said. He said they would check the captured images of the installed CCTV in the area of their investigation.

Belen was known to be a lawyer handling cases with Customs in the area. However, police found out that he's not listed as a party that had transactions with Customs nor he was listed as a government employee or official at the BOC.
