Ed Sheeran faces $20 million lawsuit after allegedly plagiarizing "Photograph"


British song maker faces accusations of copying his hit song.

International singer and award-winning songwriter Ed Sheeran and his co-writer Johnny McDaid are being sued for $20 million after facing accusations of plagiarizing their hit song, "Photograph" from an X Factor song.

Songwriters Martin Harrington, Thomas Leonard and their publishing company filed a lawsuit and seek $20 million on the claim that Sheeran and McDaid copied the tune from the song "Amazing" by 2010 X Factor winner Matt Cardle, which was written and released on 2012. On the other hand, Sheeran's "Photograph" was released on 2014 and made it to the top 10 of Billboard Hot 100.

According to a recent report published in MTV, the lawsuit was filed on a federal court in Los Angeles on Wednesday. It states:

"This is an action for willful copyright infringement in which Sheeran and McDaid, the credited writers of the international hit song Photograph, among others, copied, and exploited, without authorization or credit, the work of other active, professional songwriters, on a breathtaking scale, unabashedly taking credit for the work of these songwriters by claiming it to be their own. This copying is, in many instances, verbatim, note-for-note copying, makes up nearly one half ofPhotograph, and raises this case to the unusual level of strikingly similar copying. The chorus sections of Amazing and the infringing Photographshare 39 identical notes - meaning the notes are identical in pitch, rhythmic duration, and placement in the measure." 
Reports also stated that despite of being aware of the lawsuit, Sheeran still continued to perform the song and even licensed it out for Emilia Clarke starring Me Before You.

Harrington and Leonard will be seeking statutory damages and will also be represented in court by Richard Busch, the same attorney who won the copyright infringement case against singer Pharell Williams and Robin Thicke last year.

On the other hand, Matt Cardle has finally spoken up about the issue and said that he was not involved in the lawsuit nor was it his. In a tweet, Cardle expressed his compliments to Sheeran and advised fans to read news articles carefully before commenting:

Sheeran's representatives have not yet commented about the lawsuit.
